Site Readiness: ensure that areas scheduled for work are reasonably prepared, personal valuables are removed or protected, and furniture and fixtures are cleared where required.

Approvals: provide timely decisions, approvals, and instructions necessary for project progression. Failure to provide such access or approvals may result in project delays.

10.4 Materials

Cloud Paints may supply paint products, coatings, decorative materials, waterproofing products, and accessories and consumables. Where materials are supplied by the Client, Cloud Paints shall not be responsible for material quality, performance, compatibility, or defects. Any delays caused by Client-supplied materials may impact project timelines.

10.5 Surface Preparation

The quality and longevity of paint finishes depend significantly on substrate conditions. Cloud Paints shall undertake reasonable surface preparation; however, hidden defects may not be apparent until work begins, additional preparation requirements discovered during execution may incur additional costs, and existing structural issues, dampness, mould, cracking, or substrate failure may require separate remedial works. Such works shall be quoted separately where necessary.

10.6 Variations and Additional Works

Any request to change colours, modify specifications, add work areas, or alter project scope shall constitute a variation. Variations must be approved by the Client and may affect project costs, completion timelines, and require additional materials. Cloud Paints reserves the right to issue revised quotations for variations.

10.7 Project Delays

Cloud Paints shall not be liable for delays caused by adverse weather conditions, force majeure events, utility interruptions, material shortages, government actions, site inaccessibility, or Client-requested changes. Project timelines may be adjusted accordingly.

10.8 Quality Assurance

Cloud Paints is committed to delivering professional workmanship consistent with industry standards. Minor variations in colour appearance, texture, sheen levels, and finish characteristics may occur due to lighting conditions, surface conditions, and product manufacturing tolerances. Such variations shall not constitute defects.

10.9 Inspection and Acceptance

Upon completion, the Client shall inspect the completed works. Any concerns must be communicated within seven (7) days of completion. If no concerns are raised within this period, the work shall be deemed accepted.

10.10 Warranty

Where applicable, Cloud Paints may provide workmanship warranties subject to proper use and maintenance of the painted surfaces, absence of structural movement, absence of water ingress or substrate failure, and compliance with manufacturer recommendations. The warranty shall not cover normal wear and tear, abuse or negligence, vandalism, environmental damage, acts of nature, or third-party modifications or repairs. Warranty terms may vary depending on project specifications and materials used.

10.11 Health and Safety

Cloud Paints shall maintain reasonable safety practices while performing services. Clients must keep unauthorised persons away from active work areas, comply with site safety instructions, and report known hazards before work begins.

10.12 Payment Terms

Payment terms shall be specified in the quotation or contract. Unless otherwise agreed, deposits are payable before commencement, progress payments may apply for larger projects, and final payment becomes due upon project completion. Late payments may attract administrative charges and/or suspension of services.

Affected obligations shall be suspended for the duration of such events.

Either party may terminate a project agreement if the other party materially breaches these terms, required payments remain outstanding, or continued performance becomes impossible. The Client shall remain responsible for payment of all work completed and materials supplied up to the date of termination.

All designs, concepts, marketing materials, project proposals, photographs, and technical documentation produced by Cloud Paints remain the property of Cloudsent Decor Ltd unless otherwise agreed in writing.

13. Refund Policy

This Refund Policy outlines the circumstances under which refunds may be granted for products and services purchased from Cloud Paints. By purchasing our products or engaging our services, you agree to this Refund Policy.

13.1 General Policy

Cloud Paints strives to ensure customer satisfaction. Refund requests will be assessed fairly and in accordance with applicable laws and the terms outlined in this policy. Refunds may be granted where products or services fail to meet agreed specifications due to circumstances directly attributable to Cloud Paints.

13.2 Product Refunds

Refunds for paint products, coatings, decorative materials, and related items may be considered where the wrong product was supplied by Cloud Paints, the product is defective due to a manufacturing defect, the product was damaged before delivery, or the product delivered differs materially from the approved order.

To qualify for a refund, the product must be returned in its original condition where reasonably possible, the request must be submitted within seven (7) days of delivery, and proof of purchase must be provided.

13.3 Non-Refundable Products

Refunds will generally not be issued for opened or partially used paint products, custom-tinted or specially mixed paint colours, products damaged through misuse, negligence, improper storage, or unauthorised modification, clearance, promotional, or discounted items unless required by law, or products purchased from third-party distributors or resellers.

13.4 Service Refunds

Refunds for painting, coating, decorative, waterproofing, or related services may be considered where services were not performed as agreed in the contract, workmanship fails to meet reasonable industry standards, or Cloud Paints is unable to complete the contracted work due to reasons solely attributable to the Company. Where possible, Cloud Paints reserves the right to inspect the reported issue, repair defects, re-perform affected work, and offer partial compensation where appropriate. Refunds shall generally be considered only after reasonable opportunities for corrective action have been provided.

13.5 Deposits and Advance Payments

Deposits may be non-refundable where materials have already been ordered or purchased, project planning or mobilisation has commenced, or costs have been incurred on behalf of the Client. If a project is cancelled before any significant costs are incurred, Cloud Paints may, at its sole discretion, provide a partial or full refund of the deposit.

13.6 Project Cancellations

Client-Initiated Cancellations: if the Client cancels a project after acceptance of a quotation or contract, costs already incurred shall be deducted from any refundable amount, materials purchased specifically for the project may not be refundable, and administrative and mobilisation expenses may be charged.

Company-Initiated Cancellations: if Cloud Paints cancels a project without fault on the part of the Client, any payments received for unperformed work may be refunded, and any unused materials paid for by the Client may be returned where applicable.

13.7 Refund Request Procedure

To request a refund, customers should provide full name, contact information, proof of purchase or invoice number, description of the issue, and supporting photographs where applicable. Cloud Paints may request additional information to investigate the claim.

13.8 Inspection and Verification

Before approving a refund, Cloud Paints may inspect the product or completed work, conduct a site visit, request photographs or documentation, and review project records and communications. Failure to provide reasonable access for inspection may affect eligibility for a refund.

13.9 Approved Refunds

Where a refund is approved, refunds will be processed using the original payment method where reasonably possible. Processing times may vary depending on financial institutions and payment providers. Any applicable deductions permitted under this policy will be disclosed.

13.10 Exclusions of Liability

Cloud Paints shall not be responsible for refunding losses arising from improper product application by third parties, failure to follow product instructions, structural defects in buildings, water ingress, dampness, or substrate failure, natural disasters or force majeure events, normal wear and tear, or colour variations resulting from lighting conditions or surface characteristics.

13.11 Consumer Rights

Nothing in this Refund Policy limits or excludes any rights that customers may have under applicable consumer protection laws in Kenya. Where local law provides greater consumer protections, those rights shall prevail.
